The Attorney General is a constitutional officer whose principal duties are to provide legal advice and legal representation for the State, its officers, and its citizens. The Attorney General is selected by popular election. To qualify for the office, one must be at least 25 years of age, a U.S. citizen for at least seven years and a resident of Ala. for five years preceding the election. The Attorney General serves a four year term of office, is eligible for one successive term and may be removed by impeachment.
In 1819, the framers of the Ala. Constitution made specific provisions for the creation and maintenance of an attorney-general for the state who would be elected by a joint vote of the general assembly. The original term of office, as provided for by the Constitution, was four years. (1819 Alabama Constitution, Art. V, Sec. 18)
The office of Attorney General actually originated in 1807 when the Mississippi territorial legislature provided for an appointment "East of the Pearl", in an area which is now within the State of Ala. Once Ala. achieved its territorial status, the office was retained (complete with its previously authorized powers). The official's primary duties, however, were to preside over the superior courts of his particular district. In 1819, with Ala.'s rise to statehood, the office was carried into the Constitution of Ala. to be elected by joint vote of the legislature for a term of four years. Among the original duties of the Attorney General were the maintenance of an office at the place designated for the seat of government, and to conduct and prosecute in the Supreme Court, all suits in which the state may have been concerned, and to give his opinion and advice in writing, or otherwise, on any question of law when required by the Comptroller of Public Accounts, or the State Treasurer, concerning matters which related to their respective offices. He was also authorized to perform the duties of solicitor in the judicial court, embracing the place designated for the seat of the state government, and receiving in addition to the salary established by law, the fees for prosecution in such circuit, and in the Supreme Court which were allowed to solicitors for the like services. Despite constitutional amendments and revisions of 1861 and 1865, the Attorney General's previously authorized duties remained intact without any major modifications in their character. However, the Constitution of the State of Ala. 1868 provided for the direct election of the Attorney General by the electors of the State at the time and places at which they shall vote for Representatives, thus modifying the previously authorized system of legislative nomination and approval. Furthermore, the term of office for the Attorney General was reduced considerably from four years to two years; however, the actual character of the officer's duties remained constant. The Constitution of Ala. of 1901 set forth that the Attorney General would be elected by the qualified electors of the state at the same time and places appointed for the election of members of the legislature in the year 1902, and in every fourth year, thereafter, thus modifying the electoral process for the office. Furthermore, this Constitution also set forth new guidelines regarding the terms of office for the Attorney General. It stated that the Attorney General elected after ratification of the Constitution would hold his respective office for the term of four years from the first Monday after the second Tuesday in Jan. next succeeding his election, and until his successor shall have been elected and qualified. In addition, the Constitution made new arrangements which emphatically forbade an Attorney General from succeeding himself. (Constitution of Alabama of 1901, Art. V, Sec. 114, 116)
From 1933 to 1940, the Attorney General, along with the Governor and State Comptroller, functioned as the Ala. Warrant Commission (Markley, p.112).
In 1935, the previously authorized and allocated powers of the State Securities Commission were conferred upon the Attorney General. Upon that conferral, the Attorney General was invested with all the authority, rights, privileges, and immunities of the State Securities Commission. Additionally, said officer was thereby legally authorized to prosecute all cases before said commission, pending and undetermined, as well as to reorganize said commission in any way, shape, or fashion he deemed necessary, proper, and expedient to the administration, expedition, and perpetuation, of said commission's previously allocated and authorized duties/functions (Acts 1935, No. 509, Sec. 1-4).
The 1940 Code designated that the office be renamed State Securities Commissioner (Markley, p. 100).
In 1959, the Ala. Securities Law, 1959, was passed. Said act repealed the previously authorized law relating to securities. Furthermore, the act contained provisions relating to fraudulent and other prohibited practices, registration of dealers and salesmen, registration of securities, registration by notification, registration by coordination, registration by qualification, denial, suspension, and revocation of registration, general definitions pertaining to securities, exempt securities, exempt transactions, consent to service of process, misleading filings, unlawful representations concerning registration or exemption, investigations and subpoenas, injunctions, criminal penalties, civil liabilities, judicial review of orders, administration of said act, proof of exemption, short title, severability of provisions, repeal and saving provisions, and warnings to public.
In 1969, the Ala. Attorney General, office of State Securities Commissioner was legally abolished. In lieu of said office, the Ala. Securities Commission was established, thus ending the Attorney General's regulatory control over the state's securities industry (Acts 1969, No. 740, Sec. 1-2)
In recent years, holders of this office have undertaken a more broad interpretation of the constitutionally-allocated powers of the office; however, the powers of the office have remained the same. Coinciding with the Attorney General's role as "Alabama's chief attorney", he also serves ex-officio memberships on the Alabama Public Hunting and Forestry Association, Board of Compromise, Board to Prepare the Revenue Bill, Building Commission, State Oil and Gas Board, Board of Canvassers of Election Returns, State Safety Coordinating Committee, Alabama Building Finance Authority, Alabama Building Authority, Alabama Highway Authority, Alabama Education Authority, Alabama Highway Finance Corporation, and the Securities Commission. Furthermore, he carries out several more legally-inclined duties which are vital to the administration of the state's governmental programs. He serves as a legal advisor to all state, county, and municipal officers, departments, boards, and commissions, which ask advice on official business. He, also, represents the state before all federal and state courts in all cases which Ala. is a party or has an interest and is legal representative for all state, county, and municipal officers. Furthermore, he is responsible for the institution of proceedings to enforce the rules and regulations of state, county, and municipal officers. He may also institute proceedings against agents of the State in the name of the citizens of Ala. (Alabama Government Manual, 1982)
The Attorney General appoints the State Toxicologist upon the nomination of the State Chemist, and assigns an assistant from the Attorney General's Office to be Legal Advisor to the State Tenure Commission. Approval of the Attorney General is necessary for the appointment by the Highway Director of a Chief Counsel and five assistant counsels for the Legal Division of the State Highway Department. Also, the Attorney General's Office represents the interests of the State at all meetings of the Board of Education and the State Board of Adjustment. The Attorney General also serves several other inherent duties which are pertinent to the State's administration. Among these are the preparation of all contracts and writings in any matters in which the State has an interest as well as the examination and approval/disapproval of all cost bills presented to the State in criminal cases where the costs are claims or charges against the convict fund. He also publishes a quadrennial report and quarterly copies of formal opinions as well as being physically present at the destruction of all cancelled bonds. (Alabama Government Manual, 1982)
To more efficiently facilitate the administration of our State's programs, the Attorney General appoints a Deputy Attorney General, an executive assistant and an administrative assistant who serve at the Attorney General's pleasure. The Deputy Attorney General exercises such powers as the Attorney General delegates and exercises the full power of the Attorney General when the Attorney General is absent. Qualifications for this office are the same as those for Attorney General. Furthermore, Assistant Attorneys General are employed outside the Merit System and become subject to its provisions at the successful completion of the probationary period. The Office of the Attorney General also employs secretarial, administrative, and investigatory personnel. (Alabama Government Manual, 1982)

On 1955 Dec. 1 Rosa Parks was arrested for refusing to give up her seat on a Montgomery, Ala., municipal bus to a white person. As a result the black citizens of Montgomery chose to boycott the city's bus system in hope that they could force the bus company and the city to adopt changes to the segregated seating policies. Many of the more vocal blacks banded together to form the Montgomery Improvement Association (MIA), electing the Rev. Martin Luther King, Jr. president. The boycott continued into 1956 Feb., when negotiations between the MIA and the city commissioners and bus company officials stagnated. On Feb. 21 eighty-nine blacks including King were indicted for the misdemeanor of conspiring to boycott. The Alabama anti-boycott law was passed in 1921 in response to the violent strike of Birmingham coal miners. Martin L. King was brought to trail in Mar. and although he was convicted Judge Eugene W. Carter refused to sentence him to prison on the grounds that King had worked to avoid violence. This series consists of the State Attorney General's copy of the transcript of the Circuit Court trial that occurred on 1956 Mar. 19. In addition to King, Roy Bennett, E.N. French, and E.D. Dixon were named as defendants. Attorneys for the defense were Fred D. Gray, Charles D. Langford, Orzell Billingsley, Jr., Peter A. Hall, and Arthur D. Shores. Maury D. Smith, Robert B. Stewart, and William F. Thetford served as prosecuting attorneys. Witnesses included: J.H. Bagley, Willie Chisholm, Erna Dungee, U.J. Fields, R.S. Graetz, Beatrice Jackson, Rufus Lewis, Joe Foster, D.S. Johnson, C.E. Moseley, Hezekiah Nunn, J.B. Sadler, C.H. Williams, Joseph Alford, Joe Alford, Joe Azbell, Mary Banks, A.E. Beasley, M.O. The Secretary of State was responsible for issuing land patents to people who bought swamp and overflowed lands granted to the Ala. Insane Hospital for disposal (1907 Code, Sec. 881) and for land claims settled by the Board of Compromise for School Lands (1919 Acts of Ala., No. 442, Article 40, Sec. 25). The Secretary of State could also issue conveyances for state land not used for government purposes, if an Attorney General's opinion supported the conveyance (Code 1923, section 6851). The Secretary of State is also charged with keeping records of land patents and conveyances issued by the State. This series consists of handwritten, typewritten and printed copies of land patents, conveyances and related documents such as correspondence, plats and Attorney General's opinions. The land patents are for swamp and overflowed lands and school lands. Generally patents include the purchaser's name, the location of the land and the cost of the land. The patents were issued by the Secretary of State for the Governor. Most of the conveyances are from the 1930s and each includes supporting documentation. A large portion of the conveyances relate to the State Docks.

The Attorney General furnishes written opinions on questions of law to state departments and agencies, legislators, and local government officials. The opinions do not have the force of law but serve as a back-up or support for the actions of officials. These opinions are bound in quarterly, bimonthly, or monthly volumes, and the letters are arranged in chronological order. They are carbon copies. The formal opinions are also published in the Quarterly Reports from 1935 until the present. Opinions may also be found in the Biennial Reports of the Attorney General from 1896 to 1938. The series contains compiled indexes of the opinions which include the office editions, Biennial Reports, and Quarterly Reports. Cumulative indexes in various formats from about 1926 to 1978 were prepared by the Department of Examiners of Public Accounts.

Before a patent for a sixteenth section land was issued, the Attorney General has to be satisfied that the state had no claim on the lands through any of its departments and that the petitioner had resided on the land for at least ten years. The Attorney General collected affadavits and memoranda in an effort to ensure that the above qualifications had been met. If the qualifications were met the Attorney General would certify this to the Secretary of State who would issue the patent.

One of the activities used to accomplish this function is documenting historical or significant events that occur in the state. This series is an artificial collection of documents generated by various state agencies regarding the "Scottsboro Boys case." In 1931 nine African-American men were accused of raping two white women on a train that was stopped in Jackson Co., Ala. The records are from the state Board of Administration and the state Attorney General's office. The series includes three sets of records. One is a trial transcript of the testimony given on 1933 Mar. 31 in the Circuit Court of Morgan Co., Decatur, Ala., before Judge James E. Horton. Defendant Haywood Patterson was represented by Samuel S. Leibowitz, George W. Chamlee, and Joseph R. Brodsky. Prosecuting attornies were Attorney General Thomas E. Knight, Assistant Attorney General Thomas Seay Lawson, Wade Wright, and H. G. Bailey. Witnesses for the state were: Victoria Price, Dr. R. R. Bridges, W. H. Hill, Tom Rouseau, Lee Adams, Ory Dobbins, Arthur Woodall, Dr. Cary Walker, Dr. J. H. Hamil, and Vertus Frost. The defense called: R. S. Turner, Dallas Ramsey, Norris Payne, Beatrice Maddox, G. W. Chamlee, Willie Roberson, Olen Montgomery, Ozie Powell, Andy Wright, Eugene Williams, Haywood Patterson, Percy Ricks, Dr. Edward E. Reisman, Lester Carter, E. L. Lewis, May Jones, and Ruby Bates. The second item in the series is the Brief of Respondent filed on 1932 Sept. 24 by Attorney General Knight and Assistant Attorney General Lawson before the U.S. Supreme Court in response to the appeal for a retrial by the nine convicted men. The final set of records is the Board of Administration's reports on the sentences of Ozie Powell, Charlie Weems, Andy Wright, Clarence Norris, and Haywood Patterson. These forms, dated 1938 Nov. 1, provide information on the dates of prison terms and remarks on the individuals' behavior in prison.

The attorney general's office "must attend, on the part of the state, to all criminal cases pending in the supreme court or court of criminal appeals" (Ala. Code, 36-15-1[3] [1975]). The Capital Litigation Division handles the appeals of all capital (death sentence) cases which have gone beyond the circuit court. A capital case can be appealed up through the Alabama state courts to the U.S. Supreme Court and back down again or it may be appealed through the federal appeals court system up to the U.S. Supreme Court. These records document the activities of the division in handling the prosecution of such cases through all of the appellate courts. The case is closed when a defendant is executed, set free, or is given a final sentence other than death. Specific documents in the files may include petitions for review by the Alabama Court of Criminal Appeals, briefs on applications for rehearing, briefs for the state, reply briefs from the attorney general, petitions to the U.S. Supreme Court, briefs to the U.S. Supreme Court. Some of the files contain photographs used as exhibits or evidence. Information in the files includes full details of the original trial, and all legal points and arguments relative to the case.

The files of the Board of Compromise document the adjustments, compromises and settlements of any claim of the State against any person, corporation, or public officer or his sureties as decreed by the governor, attorney general and the state auditor. For decisions regarding school lands, the board consisted of the governor, attorney general and the state superintendent of education. These records contain the petitions and final decrees for compromise and settlements between the State of Alabama and state and county officials for incorrect or misuse of public funds and between the State and Alabama citizens who fail to meet the payment of sales or income tax assessments or possible frauds. Claims are for debts or money demands owing or claimed by the state. An alphabetical index is in the first box. Minutes of meetings may be included. The Board may compromise a claim against an insolvent person for relief of indebtedness against the State; i.e., final assessment of income tax and may release all liens of record upon payment to the Treasurer's Office. Included with the decrees of settlement by the Board of Compromise are inserted 13 decrees pertaining to the Board of Compromise For School Lands. Created in 1919 the act regarding this latter board was repealed in 1939 by the Legislature.

According to the Alabama Government Manual, Sixth Edition (1982), "the Attorney General is a constitutional officer whose principal duties are to provide legal advice and legal representation for the State, its officers, and its citizens." These files deal with criminal cases in which the Office of Attorney General was involved. Files which concern cases brought to the state Court of Appeals or the Alabama Supreme Court have carbon copies of pertinent notices, motions, writs, and decrees. The remaining files simply contain carbon copies of writs or pleadings. They may also contain newspaper clippings and copies of the Southern Reporter which mention the particular case.

By a legislative act of 1883 Feb. 5, solicitors of the local courts (city courts, circuit courts, etc.) were required to send reports to the attorney general at the end of each term of court. The reports show the number of criminal cases, types of offenses, and their disposition. The reports provided the raw data which was included in the attorney general's biennial report. The law requiring these reports was repealed by an act of the legislature on 1943 July 12. Previously, in 1935, an act was passed requiring the attorney general to publish quarterly reports of official opinions instead of biennial reports. The office of solicitor was abolished effective 1977 Jan. 16, by the Code of Ala. 1975.

On the night of 1954 June 18, Attorney General-elect Albert L. Patterson was assassinated in his hometown of Phenix City, Ala. Patterson had campaigned on a platform of anti-vice in Alabama. He was particularly concerned with cleaning up Russell County and Phenix City. Patterson's son John was appointed to fill the position of Attorney General. This series consists of correspondence, memoranda, trial transcripts, litigation documents, wanted posters, handwritten notes, transcriptions of interviews, photographs, and other material created and/or maintained by assistant Attorney General Bernard F. Sykes during the course of th einvestigation and litigation concerning Patterson's murder. The State prosecution team also consisted of Attorney General John Patterson; MacDonal Gallion and George Young, assistants to the Attorney General; and James Webb, Council. The case of Albert Fuller vs. the State of Alabama began 1954 Nov. 29 with Grand Jury Proceedings. In addition to wanted posters for Willis Murrell Jowers and Clarence Olin Revel, the records contain interviews with other suspects and witnesses. Sykes' research and notes taken during the trial are also contained in this series.

These records are created/maintained to document the Attorney General's role in the legal proceedings before the Alabama Public Service Commission and the Alabama Supreme Court in which South Central Bell sought to collect additional revenues by increasing its rates after the AT&T divestiture. The outcome of this case was that South Central Bell was allowed to operate under the Rate Stabilization and Equalization (RSE) plan. Tha plan generates a rate of return within an approved range rather than one that yields a fixed rate of return. The RSE plan was also utilized by Alabama Power Company and Alabama Gas Corporation to adjust their utility rates. Information available in these records includes docket number, date, statement of case, testimony transcripts, exhibits, briefs, Public Service Commission orders, and court decisions.

Financial issues, such as state employee salaries, tax collection, interpretation of tax laws, and other subjects are discussed. The series also contains information about court cases involving financial matters of the State. Most notable is the file on the Patillo Milling Company of East Tallassee, Alabama. The owner, Ernest Patillo, entered into an agreement with Caroline S. Cavanaugh, Director of the Bureau of Publicity and Information, to manufacture samples of cornmeal for promotional purposes. Afterward the state refused to pay for the samples, claiming the agreement did not comply with state law regarding the promotion of tourism in Alabama.

In 1985, John Dillard and others initiated a class-action suit on behalf of black Alabamians in Federal District Court in conjunction with the Alabama Democratic Conference (the black arm of the Alabama Democratic Party) and the NAACP charging that Crenshaw County and 159 other voting districts systematically violated the 1964 Voting Rights Act through their method of holding at-large elections. Dillard's efforts, which lasted until 1988, succeeded in forcing 160 counties, cities, and school boards throughout the state to adopt single member district elections rather than at-large elections. The collection contains all motions and counter-motions concerning both Dillard and the State (which defended the at-large electoral bodies), collateral attacks, news releases and clippings relative to the strategy and decisions of the courts in this landmark case.

Included topics are statistics, the environmental impact, current land reclamation and principles of good reclamation, options for the future, and sources of reference. Earl Bailey prepared the report, published by the Alabama Environmental Quality Association.

In Act 102, General Acts of Alabama, approved 1933 Mar 29, the attorney general was made ex-officio bond commissioner of Alabama. These records contain the files of individual municipalities issuing bonds for construction of water and sewer systems. They include copies of local ordinances, correspondence between localities and the attorney general, copies of correspondence between the attorney general and the Federal Reserve Bank in Atlanta, and other pertinent items. Most of the bond issues were purchased by the PWA or WPA, with the Federal Reserve acting as fiscal agent. By the law, all such bond issues had to mature in less than forty-five years.

Code, Chapter 25, Article 4, Section 861 [1923]). These attorneys are given a commission as a special assistant to the attorney general. (Ala. Code, Chapter 25, Article 4, Section 863 [1923]). This series consists of a bound volume of statements taken from the members of Company M, Tuscaloosa, Alabama National Guard and compiled by Judge Horace C. Wilkinson, Assistant Attorney General. The statements relate to the lynching of Willie Beard and are in transcript form. The lynching of Beard was related to the murders of mine worker John Northcutt and National Guardsman Private James Morris during the United Mine Workers strike at Nauvoo, Walker County, Alabama in 1920-1921.

According to the Code of 1867, the Attorney General was ordered to report annually to the Governor in a consolidated form from the reports of solicitors of judicial circuits on the character, number, and result of criminal cases in each county. He was also directed to make suggestions for the suppression of crime. Earlier reports contain both narrative and tabular summaries. Topics included in the narrative section are civil business, criminal matters, solicitors' reports, impeachment proceedings, tax cases, Supreme Court business, changes in criminal laws, suggestions, and opinions. The tabular section classifies offenses and numbers persons prosecuted, by Judicial Circuit and county, including the nature of the offense; the number of cases prosecuted, disposed of, acquitted, convicted, and nolle prosequies; the punishment imposed; and remarks. A recapitulation for each county, including the predominant offense, concludes each section. Counties may be divided into city, county, or criminal courts, and a recapitualation for the state may give the predominant crime by the name of the court. Legislation in 1893 requested the Attorney General to report to the Governor in Oct. of even numbered years. He was again asked for suggestions for the suppression of crime and the improvement of criminal administration; to provide statistics on criminal cases for the entire state in each judicial circuit and city, criminal, or other court; and he could include opinions deemed of public interest. (Code of 1896). Later reports are organized into three sections: (1) a statement of civil cases pending or disposed of, in which the state is interested; (2) official opinions that deal with questions of public interest or that will aid state and county officers (from 1896); and (3) a tabulated statement of criminal cases showing the number, character, and result. The reports may also include lists of Attorneys General, lists of circuit, city, and county solicitors, and tabulations of criminal appeals to the Supreme Court.

Legislation in 1931 authorized the State Securites Commission to promulgate rules and regulations as necessary to carry out duties of the Securities Act. The rules are designed to produce uniformity of practice before the Commission and to eliminate the practice by applicants of trying to obtain commitments from the Commission in connection with proposed applications before filing the actual applications to be decided. Examination of the rules should eliminate much correspondence concerning procedure and policies of the commission and also enable the Commission to perform its administrative functions more effectively. The series shows the Commission's attempt to provide protection to investors while minimally regulating honest business. Duties of the Commission were conferred upon the Attorney General in 1935. The office was later designated State Securities Commissioner. Similar rules and regulations were created by the State Securities Commission.
