Five manuscripts, one map, and four books formerly belonging to various members of the Van Cortlandt family: New York (Colony) Laws, Statutes, etc. Lawes Establish'd by the Authority of his Majesties Letters Patents... By virtue of a Commission from... James Duke of Yorke... 1664. This first set of laws for New York, commonly known as the "Duke's Laws," were promulgated by Governor Richard Nicolls, after a meeting with representatives in Hempstead, Long Island, on March 1, 1664. Bound with this code are nine additions most of which are "Orders made at the Generall Court of Assizes held in New York," 1664-1672. The texts are written in several different hands and signed variously by Richard Nicolls (1624-1672), first governor of New York, 1664-1668; Matthias Nicolls (1630?-1687), Richard's brother and secretary to the province during the period covered; and Francis Lovelace (1618?-1675?), brother of the poet Richard Lovelace and governor of New York, 1668-1673. Written copies of this code were prepared for all the towns on Long Island. Of these copies only four are apparently extant, including this one and one in the New York Historical Society.

Manuscripts, in two hands, of a collection of 17 letters to Charles Montagu, Duke of Manchester, while Montagu was ambassador-extraordinary at the court of France. The letters concern diplomatic affairs, many detailing King William III's responses to Montagu's reports. Several letters discuss the treatment of English seamen and other English subjects in France; one letter concerns a petition for King William's protection for those on an English ship seized by the French, while another reports on the violence done to an English ship attacked by a French ship, contrary to treaties between the two countries. Others refer to the proposed restitution of the town of Brisae; two letters concern the escape of the "villain" Count Boselli, an Italian under the protection of France who had threatened to assassinate King William III; and the last letter refers to the mourning King William III will undertake upon the death of James II, encourages Montagu to do likewise, and recalls him to England. Fifteen of the letters are autograph; and two are in another hand.

Manuscript on paper, in a single hand, containing two speeches relating to the prosecution of seamen as pirates who had been fighting under King James' commission. The first piece consists of Oldys's testimony before the Lords of the Council and Commissioners of the Admiralty, in which he refused to prosecute these men, declaring that "pyrates are common enemies to all mankind, having no Legal Authority for what they do, but these shew a Commission signed James Rex," while the Lords of the Council argued that James II had no power to write such a commission, having been deposed by King William III. The second piece consists of the speech to Parliament by the prisoners John Golding, Thomas Jones, John Ryan, Darby Collins, Richard Shevers, Patrick Quidly, John Slaughter, and Constaine De Hartley, in which they appeal the decision to condemn them as traitors.

Manuscripts, in a single hand, containing copies of 373 letters arranged in chronological order and dated between 1641 and 1688, and extra-illustrated with many prints and drawings, primarily engraved portraits of the correspondents. The letters in the first volume are addressed to William Legge, and mainly discuss political and military activities, including tactics during the English Civil War; correspondents include Sir William Davenant and King Charles I. This volume also contains numerous letters concerning the marriage negotations of John Butler, 1st Earl of Gowran, the son of the Duke of Ormonde. The letters are annotated in red ink. The work is prefaced by a letter to William, 4th Earl of Dartmouth, by Bagot, Dartmouth's relative. The second volume contains letters addressed to Legge's son, George Legge, 1st Baron Dartmouth, which primarily concern political affairs. Many letters are from James II, which refer to his exile and his attempts to return to England. Others mention the Rye House Plot; congratulate Dartmouth on becoming Master of the Ordinance; and discuss opposition to King Charles II. Several letters request Dartmouth's help in releasing Philip, Baron Wharton from the Tower. The third volume contains letters addressed to Baron Dartmouth, which primarily concern preparations for a naval resistance to the expected invasion by William, Prince of Orange. Letters include instructions from the Admiralty naming Dartmouth an Admiral of the fleet and instructing him to oppose William's landing; and letters from James II and Samuel Pepys providing rumors and information on the movements of William's fleet.

Three letters to a Committee of the Privy Council also concern defense, Scarborough, silk, and western exploration. A letter to Berkeley concerns other English colonies. In addition the collection contains a page of minutes of the Council for Foreign Plantations ordering Berkeley to supply information; a warrant to pay him two thousand pounds; an order to award him for a shipment of Virginia products; and a General Court decision concerning the Scarborough case. In addition there are five petitions concerning tobacco, Berkeley's expenses, Nova Scotia, and Bacon's rebellion.

William Penn indenture, 1682, August 21.
An indenture signed by James, Duke of York and Albany, granting what is now the northern part of the state of Delaware to William Penn, August 21, 1682. In the indenture, James grants to Penn "the town of New Castle ... and All that tract of Land lying within the compass or Circle of twelve miles" from there, in exchange for five shillings a year, to be paid at the feast of St. Michael the Archangel. According to an inscription on the back, the indenture was recorded in Patent Book no. 1, page 480, in the Rolls Office in Pennsylvania, on February 7, 1783. This indenture, however, had almost immediately been superseded by another one dated August 24, 1682 (which is in the Delaware Public Archives), which granted the same territory, but contained additional clauses not found in this one dated August 21. It is not known why two such similar grants exist, but this earlier one may have been a draft document, even though it is signed. Or perhaps, after signing this copy, James or Penn, or both, realized that some things were left out and so the August 24 document was drawn up. It is also not known who kept the indenture or why it was recorded in the Pennsylvania Patent Book. (The August 24 indentures granting Pennsylvania and Delaware to Penn had been retained by the Penn family in England until the early 19th century.) More information about William Penn's grant from the English crown may be found in the article "William Penn Indenture" by E. Richard McKinstry, which appeared in Winterthur Magazine, fall 2001.

Contemporary copy of the laws established in 1665 by James, Duke of York, for the government of the colony of New York, drawn up by Gov. Richard Nicolls in anticipation of a meeting called by him in February 1665, to bring a more uniform system of government to the towns of the newly created shire of York (now Long Island, Staten Island, and Westchester County). Copy was sent out following the proclamation of the laws at Hempstead; intended recipient has not been identified.

Closing out the two speeches is a panegyric, post 1711, eulogizing the late Grand Dauphin Louis, and a postscript statement in a later hand praising Cosnac and the French effort to eradicate Calvinism.

Letter copy book kept by the British Envoy, an Italian, concerning a projected marriage between the Duke of York and the Archduchess Claudia Felicitas, addressed principally to Lord Arlington, the Duke of York, the Earl of Sunderland, Sir William Godolphin, the King, Sir Joseph Williamson, the Duke of Richmond, Sir William Swan, Lord Clifford, Sir Jonathan Trelawny and various ambassadors. A leaf pasted inside the cover, giving styles of address, includes the abbot of Lambspring; in 1672 the abbot was John Placid Gascoigne. One letter is from the emperor Leopold to Claudia's mother and another from the Earl of Peterborough to the King. At the end is a summary of the times of various postal services in Europe and a list of letters written, March 14 to December 29. Thought to be written by Bernard Gascoigne, the English resident at Vienna.

Collection of papers relating to the Popish Plot, 1678-1679.
Collection of seven manuscripts, in multiple hands, concerning the Popish Plot, primarily of testimonies and accusations. The collection contains a letter by an unnamed woman to Coventry promising to deliver to him the names of many priests and Jesuits for a promised reward, as well as Coventry's reply assuring her she will be paid. Other items include a report on the death of Sir Edmund Berry Godfrey; King Charles II's speech to the House of Lords in 1678; a signed statement by Sir John Werden, declaring that he had been sent by the Duke of York to Titus Oates to confirm that Oates had spoken with Sir Thomas Williams; and a signed statement by Roger Hyett declaring that John Birch had accused the Queen and the Duke of York of being Papists.

Manuscript, in a single hand, of a copy of a speech by the House of Commons to King Charles II, remonstrating against the marriage between James, Duke of York, and Princess Mary Beatrice of Modena, "or any other of the Popish religion," warning that "if the marriage do proceed, it will be a means to disquiet the mind of your protestant subjects." The speech is followed by King Charles II's speech at the Prorogation of Parliament on November 4, 1673, in which he reprimands Parliament for fomenting discord at home instead of uniting against enemies abroad, assures Parliament that he will do his part to testify his zeal against popery, and declares Parliament will be to blame if laws against popery are not effectually put into execution.

Manuscript on paper, in a professional hand, of a proposal to reduce the Crown dependence on Parliamentary grants by improvements in tax collection, abolition of private interest charges on advances for wartime supplies, and the maintenance of sub-treasuries at strategic locations. Text is probably a variant of A Friend to Caesar, or, An humble proposition....by a person of honour (London: 1681) and may have been composed originally during the third Dutch War (1673). Volume also contains material relating to the refusal of Peter Oldish (or Oldys) to prosecute seamen loyal to James II for treason and piracy in 1693. Headed "Severall Privatiers were taken a year since...," it reports Oldish's defense of himself before the Council, under interrogation by Sir John Trenchard. Other contents include two short papers on the registry of deeds and transactions and a copy of "An Act to restraine the Number of Officers sitting in the House of Commons."

Fenwick was found guilty because King William did not want to take on his more powerful opponents. Memo inside front cover signed "J.B.M."

Manuscript volume in several hands, including Gascoigne's, containing drafts and transcripts of diplomatic letters sent by Gascoigne to various members of the English government during his service as Ambassador Extraordinary to the Hapsburg court in Vienna in 1672-73. Gascoigne's mission, ultimately unsuccessful, was to negotiate a marriage between James, Duke of York and the Archduchess of Innsbruck, Claudia Felicitas, and the letters contain detailed reports on the progess of those negotiations, including their rapid failure after the death of the Empress Margarita Teresa in March of 1673. Other topics include the uneasy relations among England, Holland, and the Empire; the first news of the revolt of Imre Thököly in Hungary; and the Russian Czar's mission to raise Europe against the Turks.

This list is followed by a list of the officers and ministers of justice; officers and ministers of the court of revenues; officers at arms; positions in the royal household, including the larder, kitchen, cellar; and keepers of forests, houses, and other public lands and buildings in the counties of England, along with the amounts of their salaries.

The series is a charter from Charles II, King of England, granting land to his brother James, Duke of York (later James II King of England). By setting up this proprietary colony by granting this secret royal patent, it was hoped that the Dutch influence in North America could be curtailed and that the independent tendencies of the Massachusetts Bay Company could be brought under control. The charter was awarded on March 12, 1664, and gave James the authority to send an armed force to compel the Dutch surrender of the New Netherland province to the English. It grants territory that now comprises most of Maine, part of Connecticut, New York, New Jersey and part of Pennsylvania to James and his heirs in perpetuity. It also specifies details of governance, including powers, privileges, and duties that accrued to the grant, and provides for its management by allowing James and his heirs to delegate administrative functions (relating to matters of law, trade, rebellion, and defense) to assigned deputies, agents, commissioners, or governors.
