William Gaston of New Bern, N.C., was a lawyer, state legislator, United States representative, and North Carolina Supreme Court judge.
William Gaston (1778-1844) of New Bern, N.C., was a lawyer, state legislator, United States representative, and North Carolina Supreme Court judge.
William Gaston was born in New Bern, N.C., on 19 September 1778. His father, Alexander Gaston, was a prominent physician of the New Bern region who received his medical degree from the University of Edinburgh, and served as a surgeon in the British navy. The elder Gaston, a Protestant Irishman of Huguenot descent, settled in North Carolina in 1765. He was married in 1775 to Margaret Sharpe, a convent-educated Englishwoman from a family of devout Catholics. The couple had three children: William; his sister Jane, three years his junior, who married John Louis Taylor; and an elder son who died in infancy.
With the outbreak of the American Revolution, Alexander Gaston became active in the patriot cause. On 19 August 1781, he was killed by the leader of a band of Tory raiders at New Bern. Margaret Sharpe Gaston, left with the care of two infants, raised her children in the Catholic faith.
In the spring of 1791, the twelve-year-old William Gaston was sent to Philadelphia, Pa., to be prepared for college. The following fall, he went to Georgetown College to become its first student. He returned to New Bern in 1793 due to poor health, and studied for a year at the New Bern Academy before he enrolled at Princeton, where he was graduated in 1796 with highest honors. He studied law in New Bern under the direction of Francois Xavier Martin, and, on 22 September 1798, he was admitted to the bar. Later in the year, when Gaston's brother-in-law, John Louis Taylor, was appointed judge of the North Carolina Superior Court, Taylor diverted a large part of his practice to Gaston.
In political matters, Gaston was a Federalist and then a Whig. He served four terms in the North Carolina Senate and seven terms in the North Carolina House of Commons. Gaston was a Federalist presidential elector in 1808, and, from 1813 until 1817, he was a member of the United States House of Representatives. As a congressman, Gaston acquired a reputation for the eloquence of his speeches, especially those supporting the Bank of the United States and opposing the Loan Bill. He denounced the War of 1812. He voluntarily retired from national politics in 1817 and on at least one subsequent occasion refused nomination to the United States Senate.
Gaston remained active in North Carolina politics. He served as chair of the judiciary committee of the North Carolina Senate and chair of the joint legislative committee that framed the act creating the North Carolina Supreme Court. In the North Carolina House of Commons, 1827-1833, Gaston served on the judiciary committee and as chair of the finance committee, a position that coincided with his interest in banking. In 1828, he was appointed president of the Bank of New Bern, and while in the House of Commons cooperated with conservative financial groups in an effort to maintain sound banking policies for North Carolina. He helped to lead the fight in North Carolina against the nullification doctrine in 1832.
Gaston took a lively interest in internal improvements for North Carolina. In July 1833, he attended an internal improvements convention in Raleigh, serving as chair of the committee to prepare an address to the state and to lay the convention's proceedings before the state legislature. The address stressed the need for colleges, railroads, hospitals, and asylums for the handicapped. As a member of the House of Commons, Gaston introduced the bill to charter the North Carolina Central Railroad.
In 1835, Gaston was an influential delegate to the North Carolina Constitutional Convention, where he fought to have religious qualifications for office holding dropped and where he attempted to protect the voting privileges of free people of color. Gaston also supported federal representation as the basis for representation in the House of Commons and biennial meetings of the state legislature.
Gaston's law practice was very successful and recognized nationally. Daniel Webster and John Marshall, among others, consulted with him on legal questions. In 1833, Gaston was elected by the state legislature to a post as an associate justice of the North Carolina Supreme Court, where he served until his death in 1844. Gaston's most famous decision on the bench came in 1834 with the case of State v. Negro Will . Gaston ruled that a slave had the right to defend himself against an unlawful attempt of a master, or an agent of a master, to kill him. In the significant case of State v. William Manuel in 1838, he held that a manumitted slave was a citizen of the state and thus entitled to the guarantees of the constitution. Gaston purchased a library for the state Supreme Court while on a trip to New York City in 1835.
In addition to his service as legislator and judge, Gaston served the public as a trustee of the University of North Carolina from 1802 until his death in 1844. For many years, he was chair of the trustees of the New Bern Academy.
Gaston received many honors during his lifetime. He was elected a member of the American Philosophical Society in 1817 and of the American Academy of Languages and Belles Lettres in 1821. He received honorary degrees from the University of Pennsylvania in 1819, from Harvard and Columbia in 1825, and from Princeton in 1835.
Gaston owned a plantation and slaves (163 at the time of his death) in Craven County, N.C., and a town house and a law office in New Bern. During the sessions of the Supreme Court in Raleigh, Gaston stayed at the home of Mrs. James F. Taylor. At his office nearby, in 1840, he wrote the words for The Old North State, the music for which he apparently adopted from a melody sung by a group of Swiss bellringers who had visited the capital. The Old North State was first performed in public at the Whig state convention in Raleigh in October 1840 and has been North Carolina's official state song since 1927.
Gaston was married three times: on 4 September 1803 to Susan Hay (d. 1804); on 6 October 1805 to Hannah McClure (d. 1813); and on 3 September 1816 to Eliza Ann Worthington (d. 1819). With his second wife, he had one son, Alexander (1807-1848), who married Eliza W. Jones and then Sarah Lauretta Murphy, and two daughters, Susan Jane (1808-1866), who married Robert Donaldson, and Hannah Margaret (1811-1835), who married Matthias E. Manly. With his third wife, Gaston had two daughters, Elizabeth (1817-1874), who married George W. Graham, and Catherine Jane (1819-1885), who did not marry.
William Gaston died in his office in Raleigh in 1844.

John James Audubon (1785-1851), the American Woodsman, is a legendary naturalist and bird artist. His technique of painting North American birds dramatically as they appeared in their natural habitat was a major contribution to the emerging discipline of ornithology in the nineteenth century. His masterpiece, (1827-1838), elephant folio, was followed by a companion text edition, (1831-1849), a smaller octavo edition of (1840-1844) and , published posthumously. This collection of original letters of publication information, ornithology, and some personal notes was sent primarily to Lucy Bakewell Audubon, his wife, from 1826-1834, and to Victor Gifford Audubon, his son, from 1833-1834, 1840-1844, with some sporadic contact with both between 1836-1839. Items in the collection relate to Audubon's Florida, Great Egg Harbor, and Great Pine Forest expeditions but not to his final expedition up the Missouri River. Of particular note, letters of 1833 and 1834 contain references to his response to the Academy of Natural Sciences of Philadelphia president George Ord's attacks on his credibility. A partial journal entry from New Orleans in 1821 and a few letters to other correspondents, including John Bachman, round out the material. The collection is primarily business papers of Walter Alves. The bulk consists of correspondence, surveys, rental accounts, and other papers pertaining to Alves's extensive land holdings in North Carolina and in the Clinch and Powell rivers areas of east Tennessee. Also included are family correspondence, letters from Federalist politicians, and papers pertaining to Alves's move to Henderson, Ky. Correspondents include Gavin Alves, Richard Bennehan, William Boylan, Duncan Cameron, Walter Evans, William Gaston, William B. Grove, Archibald Henderson, James Hogg, Alex Mebane, James Norwood, and Henry Tazewell. Many items pertain to the estate of Alves's father-in-law, William Johnston (d. 1785), mainly concerning the efforts of Edmund Fanning (1739-1818), North Carolina colonial official and Loyalist for whom Johnston had been agent, to recover properties confiscated during the Revolution. These estate papers include correspondence, 1805-1812, between Alves and John Wickham (1763-1839), noted Virginia lawyer, and relevant earlier papers.

Also included are political correspondence, 1818-1835 (26 items), and a personal account book of his father, John Heritage Bryan (1798-1870), Whig U.S. representative from North Carolina. Mitchell's correspondence pertains to his varied religious, academic, and scientific activities, including mountain exploration in North Carolina. Among the correspondents are George E. Badger, William Gaston, Francis L. Hawkes, N.M. Hentz, William Hooper, Levi Silliman Ives, Archibald D. Murphy, James H. Otey, John Stark Ravenscroft, and David L. Swain. Included is correspondence with the North family of Mitchell's wife, Maria North Mitchell, in New Haven, Conn., and from the Mitchell children after they had married and moved to Salisbury, N.C., California, and Texas. Volumes include Mitchell's diary, 1813-1816, begun at Yale and kept irregularly while he was teaching at various places in the North, containing mainly religious reflections and slight personal comment; his private notebook, 1818-1847, containing miscellaneous comments on mathematics, musicology, electricity, the natural sciences, and history, and personal accounts and notes on reading and letters received. The diary, 1878, of Mitchell's grandson, J.N. Howard Summerell, on a voyage to Scotland; Mitchell's journal, letter book, and account book, 1818-1842; and "Diary of a Geological Tour by Professor Elisha Mitchell in 1827 and 1828 with Introduction and Notes" by Kemp P. Battle, published as part of the "James Sprunt Historical Monograph Series" by the University of North Carolina in 1905.

The Hopkinson family was a prominent political family of Philadelphia and Bordentown, New Jersey. Thomas Hopkinson (1709-1751) was a merchant, a lawyer, and a diplomat. Francis Hopkinson (1737-1791), Thomas’s son, was a jurist, author, musician, and signer of the Declaration of Independence. Joseph Hopkinson (1770-1842), Francis’s son, was a Pennsylvania congressman from 1815 to 1819, a federal judge from 1828 to 1842, and author of the anthem Hail, Columbia. Joseph’s son, Oliver Hopkinson (1812-1905), served during the Civil War with the 1st Regiment, Delaware Volunteers and with the 51st Regiment Infantry, Pennsylvania Militia. Covering four generations, the Hopkinson family papers consist principally of incoming correspondence; but there are also outgoing letters, documents, manuscript notes, and printed material. All papers have been bound in volumes, and photostatic copies of most volumes are available to researchers.

Sargent and Company was a manufacturer of locks and hardware, with headquarters in New Haven, Connecticut. Originally established in New York City as a commission business, Sargent and Company relocated to New Britain, Connecticut, several years later under the name J.B. Sargent & Company. Unable to expand at this location, Sargent purchased land in New Haven, Connecticut, and moved the company, one hundred employees and their families on 1 May 1865. By 1887, the plant had expanded to sixteen acres of floor space and employed almost 1,700 employees. Joseph B. Sargent was prominent in New Haven politics and was elected mayor in 1890. In 1892, he was nominated as the Democratic candidate for governor, but was defeated. Upon his death in 1907, his brother, George Stewart Sargent, became president of Sargent and Company. In 1972, Sargent and Company became a division of Walter Kidde & Company of Belleville, New Jersey, a manufacturer of safety, security and protection products.

The correspondents include James Kirke Paulding (1778-1860), William Irving (1766-1821), Eliphalet Nott (1773-1866), Gideon Lee (1778-1841), Edmond Charles Genet (1763-1834), Peter Buell Porter (1773-1844), Stephen Allen, Calhoun, John C. (John Caldwell) (1782-1850), William Bristol, Henry Waggaman Edwards (1779 -- 1847), William Alexander Duer (1780-1858), Gulian Crommelin Verplanck (1786-1870), Francis Granger (1792-1868), Samuel Lewis Southard (1787-1842), and William Kent (1802-1861). Some letters discuss the 1824 Presidential elections and the New York politics. Also included are individual documents pertaining to military careers of Ogden Edwards's sons George Pierpont Edwards and Alfred Edwards. include letters from David Dagget (1764-1815), Jeremiah Wadsworth (1743-1804), Aaron Ogden, Oliver Ellsworth (1745-1807), Alexander Hamilton, Roger Minot Sherman (1773-1844), Johnson, William Samuel, 1727-1819 and Aaron Burr. The letters discuss local politics, Edwards's legal practice, and his social life. Also included a receipt for 250 pounds for purchasing & fitting out a privateer (October 1776). The rest of the collection are letters retained for their autograph value. This portion consists individual letters by Thomas Gage, Samuel Huntington, Stephen Girard (1750-1831), William Gaston (1778-1844), Oliver Wolcott (1760-1833), William North (1755-1836), and Marie Joseph Lafayette, and and indemnification bond to the Overseers of the Poor of Dover Hundred (Delaware, 1761).
