Richard Wayne Stites was born in Savannah. Georgia in 1802, the son of Richard Montgomery and Mary (Wayne) Stites. He received his education in New Jersey. He married Elizabeth Cook of Connecticut on August 31, 1824. They had four children together. Stites was admitted to the Bar in Savannah in 1824 and practiced law until 1832.
