Attorney general opinion : judgement, 1856.

This single item collection consists of an Attorney General opinion that was handed down in February of 1856. The Attorney General who issued the opinion was John Marshall Harlan. He was asked to take up the case by Governor Charles S. Morehead. The case involved the commissioners of the Sinking Fund and the First Bank of Kentucky. The commissioners of the sinking fund had deposited 210,000 dollars into the bank with a guaranteed interest rate of four percent. The deposit "was payable on call". The bank gave notice to the chairman of the commissioners that the "deposit was ready to be paid, and that the interest therein would cease that day." The question posed to Harlan was could the bank terminate the contract without authorization by the commissioners of the sinking fund. It was the opinion of the Attorney General that the bank could not summarily terminate the contract.
