This classification was established on October 9, 1970, following the passage of the Organized Crime Control Act of 1970 (18 USC 96). this act prohibits acquisition of a legitimate business enterprise with funds derived from illegal activitiy; acquisition, maintenance, or control of a business enterprise by illegal activity; and using a business enterprise to conduct an illegal activity.

The FBI established this classification when it assumed responsibility for ascertaining the protection capabilities and weaknesses of defense plants.
