Disposition Authorities for Individual Classifications for Field Office Case Files. Part D: Classification 8. Migratory Bird Act.

Establishment prior to 1924, this classification covers violatins of Title 18, USC, Section 43, and Title 16 USC, Sections 703 through 718. Primary jurisdiction for the protection of migratory game, fish and birds, however, rests with the Fish and Wildlife Service of the Department of Interior. Prior to 1939, the Department of Agriculture exercised primary jurisdiction in this area. Bureau policy, which remained unchanged throughout the years, was to open an investigation only upon request of the Department of Justice which has the option of referring cases to the FBI or the Department of Interior.
