John Treat Irving (1778-1838), the older brother of Washington Irving (1783-1859) and the husband of Abby Spicer Furman Irving ( - ), was a New York attorney. He became a prominent lawyer and in 1821, was appointed first Judge of the New York Court of Common Pleas, a position that he held for seventeen years.

New York City lawyer, judge and author.

An able lawyer, Irving served in the state assembly, 1816-1821, and in 1821 was appointed a judge in the city's newly-organized court of common pleas, a position he held until his death in 1838. In his younger years Irving also contributed to Washington Irving's (brother) Chronicle.
