Legal brief in the case of King vs Braxton, 1753 June 6.

A draft of the appellant's brief in the case of Walter King vs Carter Braxon (a minor represented by his guardian John Robinson) over land in Albemarle County, Va., on the James River known by the name of "the Fork." The draft states that Dudley Digges, owner of the land, mortgaged it to London merchants Micajah and Philip Perry who foreclosed and took posession. The Perrys sold the land to King in 1744 and gave power of attorney to the late George Braxton, Lewis Burwell and Richard Corbin of Virginia, authorizing them to convey the land to King. The appeal further states that Braxton refused to turn over the land, claiming it had been sold to his son George Braxton, Jr. and Charles Lewis. George Braxton, Jr., filed a bill in Chancery for conveyances, but both Braxtons died shortly thereafter and the claim was transferred to Carter Braxton. In 1751 the court ruled in favor of Braxton but ordered him to pay King for his claim. In this document King appeals the decree and asks that the decision be reversed. The brief quotes chancery documents, letters, and depositions on behalf of both King and Charles Lewis.
