The Public Defender Department was established in 1973 (1973 NM Laws, Chp. 156, Sec. 1-15). Its function is to provide legal representation at both the trial and appellate levels for indigent defendants accused of any crime that carries a possible sentence of imprisonment, parolees in parole revocation proceedings, and certain persons under provision of the New Mexico Children's Code.
