Indenture of Sir Edward Hales of Woodchirch (Kent), knight and baronet, reciting that whereas by indenture dated the last day of March now last past [31 March 1612] made between Sir Thomas Bodley of Fulham (Middlesex), knight, Sir Richard Potman of Charte next Sutton Vallance (Kent), knight, Mathew Potman, esq., and Richard Potman, gentleman, sons of the said Sir Richard, of the one part, and the said Sir Edward Hales of the other, which indenture purported to have bargained and sold unto Sir Edward Hales all that one capital messuage or tenement called "Ladd Buildings" with appurtenances in Charte next Sutton Valence aforesaid and other towns in the said indenture mentioned, in and by which indenture the said Sir Thomas Bodley for better assurance of the said Sir Edward Hales did covenant that it might be lawful for the said Sir Edward, his executors, and administrators, in the name of Sir Thomas Bodley, to have and take to his use all such bonds or covenants formerly made by any person unto the said Sir Thomas Bodley. . . . Now these presents witness that the said Sir Edward Hales doth covenant to the said Sir Thomas Bodley that when Sir Thomas shall be impleaded in the Chancery, or any court of equity, upon any such bond or covenant mentioned in the said indenture he, the said Sir Edward, shall not only bear the charge of Sir Thomas, but shall also defend and save harmless the said Sir Thomas as well, discharging all costs, losses, and damages he may incur. 20 May, 10 and 15 James I and II.
