Governor's record of death cases, 1939-1946.

The Governor is the chief executive of the state whose function is to administer the laws of the state. "In all cases, except treason and impeachment, the governor has power, after conviction and not otherwise, to grant reprieves, commutations, paroles and pardons,... (Ala. Code, Chapter 202, Section 5127 [1923]). "When punishment of death is imposed, he may commute such punishment by substituting for it imprisonment in the penitentiary, or sentence to hard labor..." (Ala. Code, Chapter 202, Section 5129 [1923]). In 1939, the governor's power was restricted to the granting of reprieves and commutations for death sentence (Ala. Code, Amendment No. 38 [1939]). This series consists of volumes kept by the governor to document the granting of reprieves and commutations of death sentences. Information in this series includes the executive order number, convict name, county, race, sex, charge (along with the name of the victim), date convicted, proposed date of execution, execution date, dates and number of reprieves (if any), or a notation that sentence has been commuted to life imprisonment.
