Kirk, a lawyer from Sterling, Illinois, was colonel of the 34th Illinois Infantry and became a brigadier general November 29, 1862. He was severely wounded at the Battle of Murfreesboro (Stones River) on December 31, 1862 and died of his wounds July 21, 1863. He had married Eliza Marcella Cameron on October 17, 1855. She later married Charles A. Thomas.
