The legal counsel of the Department of Agriculture and Industries has the same authority and duties as an assistant attorney general (Ala. Code 2-2-12 [1975]). The legal counsel acts as the department's attorney in any court actions brought by or against the department or its employees. These duties will result in creation of case files which may contain copies of summonses, correspondence, legal pleadings, depositions, affidavits, discovery material, research notes, and other records. In cases that go to court, only the pleadings will become a part of the court record.
