In July 1866, he was commissioned Lieutenant Colonel the 40th Infantry Regiment, one of the eight Colored regiments authorized by the Act of Congress of July 28, 1866. He retained his post when the regiment was consolidated with the 39th to form the 25th Infantry. Hincks retired in 1870, with the rank of Colonel of Regular Army; he was brevetted major general in the volunteer service and brigadier general in the Regular Army. He then served as governor of the National Home for Disabled Volunteers at Hampton, Virginia and in Milwaukee, Wisconsin, until 1880. He died in Cambridge, Massachusetts, on February 14, 1894, and was buried in Mount Auburn Cemetery. The couple had one daughter, Bessie, born in April of 1865.
