The State Water Control Board certifies to the U. S. Corps of Engineers or to the Federal Energy Regulatory Commission (FERC) that certain construction projects will not adversely affect the waters of the Commonwealth, under provisions of Section 401 of the Clean Water Act. In certain cases, further action by the agency is not needed, or a project qualifies for a waiver, in which case, the agency issues a letter of waiver.
