Prior to 1983, National Pollution Discharge Elimination Permits were issued by the regional office of the United States Environmental Protection Agency. In 1983, the state was given primacy over the permit process by Environmental Protection Agency, thus changing the name of the permit and the office of origination. The Permits Branch of the Division of Water became the oversight agency.

Permits are required to limit and track discharges into Kentucky waterways. The permits authorize local businesses and industries, and any facility maintained by local, state or federal governments, including water treatment plants, parks, dams, and locks, to discharge non-pollutants into Kentucky streams in compliance with the provisions of the federal Water Pollution Control Act.
