A native of Hendricks County, Ind., Smith served during the Civil War with the 133rd Indiana Infantry and the 109th U.S. Colored Infantry. After the war he finished law school and moved to Indianapolis. In 1877 Smith and John S. Duncan formed the law firm of Duncan, Smith & Duncan.
