The Board of Health was created by the enactment of Chapter 74 of the Session Laws of the State of New York in 1866. The state control of the board was transferred to the city in 1870. Then as now, the primary function of the board is the promulgation of the Health Code, and the basic laws governing health matters in the City of New York. A legislative body, the board differs from the Department of Health whose function is to enforce the board's regulations.
