In 1852, David Jacks purchased a tract of land corresponding to the 30,000 acres of Monterey city lands. The following year the Monterey town council resolved to secure confirmation of the pueblo lands title before the U.S. Board of Land Commissioners. Depositions from officials of the former Mexican California and city governments were obtained. In 1856 the title was confirmed, although legal appeals continued until 1858. Following the proposal of Delos R. Ashley, the attorney for the city petitioners and Jack's attorney, the pueblo lands were sold at public auction to Ashley and Jacks.
