In 1939 the Legislature authorized the establishment of the Division of State Parks within the Department of Conservation. Its purpose is to manage, maintain and operate all state parks, parkways, concessions, monuments and historic sites within the State Park System except Mound State Monument and the First White House of the Confederacy. In Montgomery all monuments and historical sites located on state-owned property are managed and operated by the Dept. of Finance. (Acts of Ala., 1939, No. 556; Code 1940, T. 8, Sec. 172).
In 1971 jurisdiction of Fort Mims, Fort Toulouse, Gaineswood, and the Confederate Memorial Cemetery was transferred to the Alabama Historical Commission (Acts of Ala., 1971, No. 665). The maintenance of the monument of Fort Louis de la Mobile still remains under State Parks' authority. (Code 1923, Sec. 1414; Code 1940, T. 8, Sec. 179; Code 1975, 9-14-3).
