Congressional resolution of December 27, 1776, authorized the raising of sixteen unnumbered regiments "at large." Colonel Oliver Spencer commanded his regiment, which was raised mostly in New Jersey, and was sometimes known as the 5th New Jersey, throughout its existence, January 15, 1777 - January 1, 1781. On April 22, 1779, Colonel William Malcolm's Additional Regiment was ordered to merge with it.
