James Foster was a prisoner at the Alabama State Prison at Wetumpka, Ala. In 1901 James Foster wrote to Governor W.J. Samford and (after the governor's death) Governor W.D. Jelks requesting a pardon. To prove his worthiness to be considered he sent examples of his work as a photographer.

James Foster had a lath mill and a gristmill in East Machias, Maine. With his son Charles Foster he also conducted a lumbering business and a shipyard in East Machias. In 1852 Charles Foster together with Captain William C. Talbot, Captain Josiah P. Keller and Andrew J. Pope, all of East Machias, entered into a partnership to establish a lumber business in the Puget Sound region, at what later became Port Gamble, Washington. Known variously as Teekalet Mill Co., Puget Mill Co., and Pope & Talbot Co., the business operated continuously from 1853 until 1995. Charles Foster participated in a limited way in this business and in 1863 his interest in it was bought out by Pope and Talbot.
