England and Wales. Parliament (1628). [Speeches and proceedings in Parliament], [1628].
Title:
[Speeches and proceedings in Parliament], [1628].
Manuscript, in a single secretary hand, of a collection of about a hundred Parliamentary speeches, messages, and debates, primarily on the subject of the liberty of the subject and the petition of right, and all dated 1628. The volume contains several speeches by Sir Edward Coke, including one on the freedoms of the subject, and another arguing that detaining a prisoner by commandment of the king, without expressing the cause, is against the law and liberty of the subject. Messages by King Charles I agree to draw up a bill for the confirmation of Magna Carta; respond to the petition of right; and voice his objections to the freedoms of the subject. Other items in the manuscript include the House's petition against recusants; the mayor of Taunton's complaint about billeting soldiers; and an act for the increase of shipping. At the end of the volume is a land indenture, followed by a document, on parchment, in a faded 15th-century hand.

(39) to Fleay reveals that he has lost faith in Halliwell as a scholar. (55) is accompanied by a photograph of Furness and his great grandson. (67) mentions Thackeray. (122, 144) state that he is grieved by Norris' attack on Furnivall. (233) to Dr. Platt discusses their interpretations of Shakespeare's characters and is accompanied by Platt's letter to Furness commenting on Furness' paper in the Harvard Graduate's Magazine, September 1908. Title:
A survay of the forrest of Roch alias Neroche, 1628?.
Manuscript on paper, in a secretary hand, listing owners of forest land in the forest of Neroche, with the number and acreage of "parcells" of land owned by each. The prefatory note explains that the survey is keyed by marginal letter to a "plott" of Neroche (not present). In addition to the King, the largest owners listed are the Earl of Hertford, the Earl of Bath, Sir Edward Coke, the Dean of Wells, Sir Robert Phelips, Sir George Speake, and "Mr. Ashford." The survey may be connected to the contemporary deforestation of Neroche.

Cusack, John, 17th cent. Ireland's comfort [manuscript], 1629?
Title:
Ireland's comfort [manuscript], 1629?
Containing a true and exact discovery of Ireland's colonial government, intended as a kind of supplement to Sir John Davie's A discovery of the state of Ireland, and an enterprise of reformation. The author was a supporter of the royal prerogative and speaks of himself in his dedication to Charles I as the great nephew of Sir Thomas Cusacke, sometime Lord Chancellor of Ireland, and of the injustice he has suffered in trying to recover his (Sir Thomas') inheritance "from her bastard intruders on record by an erroneous judgment of the Exchequer; and of his father's goods and chattels by his chancery suit of seven years from the heir and executrix of their wicked embezzler ... to the value of £4000" (leaf 6). Cusack refers to his imprisonment of almost 12 years under a false judgment of Woodstreet Compter London at the suit of this intruder and the instigation of Coke, then Lord Chief Justice of the King's Bench (leaf 7). He mentions his presentation to the king at the last session of Parliament of his book entitled "The kingdoms cry" composed against Coke "for his conviction of high treason in 6 several points of his said discourse against Your Majesty's immediate act of royal prerogative" hoping that it might be by his Majesty's direction published even though it was not as complete a work as he intended to make it (leaf 9).

Mellynton, Thomas,. Forty chess problems, circa 1450.
Title:
Forty chess problems, circa 1450.
Manuscript collection of forty chess problems, including diagrams and text. The manuscript was copied circa 1450 by John Porter, M.P. of Worcester, England. Diagrams and text are written in pen and dark brown ink, in Porter's hand throughout. The section on chess occupies five leaves (ff. 56r-60v) in a larger volume of collected manuscript texts. There are four diagrams on each page. Diagrams 1, 2 and 18 have no texts; the remainder have explanatory texts of up to ten lines in length. The present manuscript has the distinction of being the older of only two known problem manuscripts with texts in Middle English; the other is Bodleian Ashmole MS. 344, probably written circa 1470. The problems in the two manuscripts are substantially the same and are believed to derive from an earlier collection with texts in Anglo-Norman, of which two manuscripts survive, both in the British Library. According to H.J.R. Murray (in his History of Chess, 1913), "the workmanship [of the problems] is of an early stage of European chess, but it is European, not Muslim." Of the diagrams in the present manuscript, Murray notes, "These have been copied very negligently; the diagrams are often incorrect, and the solutions to Nos. 7 and 8 have been transposed. In seven of the positions (Nos. 1, 2, 11, 12, 18, 19, 20--all of which are exercises) the men are denoted by numerals, and the text, if any, is in Latin. In the remainder, the text is in English and the names of the pieces are written on the diagrams, and the squares mentioned in the solution bear letters for the purpose of identification. This is the ordinary rule of the mediaeval problem mss." On the matter of a source text, Murray notes, "Both MSS. [Porter and Ashmole] are written in a Northern dialect, and there is good reason to believe that an older English text lies behind them, and between them and the Latin text from which Cott. and K are other selections."

Porter, John, fl. 1445-1485. John Porter manuscript, circa 1450.
Title:
John Porter manuscript, circa 1450.
Collection of manuscript texts on a range of secular topics, predominantly copied about 1450 by John Porter, member of Parliament for the city of Worcester. It includes important early manuscript texts on hunting, heraldry, and chess, along with interesting texts on miscellaneous historical, biblical, and culinary subjects. Leaves 1r-36v, titled Tractatus de armis, comprise a treatise on heraldry, in Latin, by Johannes de Bado Aureo (i.e. John Trevor?), with blazons in French and nearly 200 colored shields. This is one of the earliest writings on heraldry to be composed in England, of which this is one of two surviving copies. According to the other known copy (British Library, Additional MS 28791), the work was compiled in 1449, being derived partly from a similar work written at the instance of Queen Anne (1366-1394). To view a detailed catalog record for this portion of the manuscript, follow the link to Johannes de Bado Aureo's Tractatus de armis, offered herewith. Leaves 37r-40r, titled The craft of venery, comprise a treatise on hunting. This short text is one of two known Middle English translations (with alterations) of William Twiti's L'art de vénerie. As huntsman for King Edward II, Twiti wrote his treatise originally in Anglo-Norman French in the early 14th century. It is considered the first work on hunting to be written in England and an important source for later writers (parts of it appear in The boke of St. Albans, 1486). To view a detailed catalog record for this portion of the manuscript, follow the link to William Twiti's The craft of venery, offered herewith.

Title:
Common Pleas reports, late 16th-century.
Contains reports in the Common Pleas, 2 Pas. 5, Pas. 7, Pas. 8 to Mich. 28 & 29 Eliz. I (1560, 1563, 1565, 1566-1586); not all dated, and some out of order. On ff. 43-50 are three cases 'Reported by Mr. Mutall'; and on ff. 85-86 dicta at York and Suffolk assizes. The reporter of the latter cases was an Inner Templar, whose informants included Henry Beaumont, John Bullock, Edward Coke, Laurence Tanfield, and Edmund Plowden of the Middle Temple. He was also in contact with the protonotaries. There exists a close comparison with the Nicholas Jordan collection in BL MS. Hargrave 373.
