The Dept. of Archives and History is charged with the function of preserving the state of Alabama's culture. One of the activities used to accomplish this function is documenting historical or significant events that occur in the state. This series is an artificial collection of documents generated by various state agencies regarding the "Scottsboro Boys case." In 1931 nine African-American men were accused of raping two white women on a train that was stopped in Jackson Co., Ala. The records are from the state Board of Administration and the state Attorney General's office. The series includes three sets of records. One is a trial transcript of the testimony given on 1933 Mar. 31 in the Circuit Court of Morgan Co., Decatur, Ala., before Judge James E. Horton. Defendant Haywood Patterson was represented by Samuel S. Leibowitz, George W. Chamlee, and Joseph R. Brodsky. Prosecuting attornies were Attorney General Thomas E. Knight, Assistant Attorney General Thomas Seay Lawson, Wade Wright, and H. G. Bailey. Witnesses for the state were: Victoria Price, Dr. R. R. Bridges, W. H. Hill, Tom Rouseau, Lee Adams, Ory Dobbins, Arthur Woodall, Dr. Cary Walker, Dr. J. H. Hamil, and Vertus Frost. The defense called: R. S. Turner, Dallas Ramsey, Norris Payne, Beatrice Maddox, G. W. Chamlee, Willie Roberson, Olen Montgomery, Ozie Powell, Andy Wright, Eugene Williams, Haywood Patterson, Percy Ricks, Dr. Edward E. Reisman, Lester Carter, E. L. Lewis, May Jones, and Ruby Bates. The second item in the series is the Brief of Respondent filed on 1932 Sept. 24 by Attorney General Knight and Assistant Attorney General Lawson before the U.S. Supreme Court in response to the appeal for a retrial by the nine convicted men. The final set of records is the Board of Administration's reports on the sentences of Ozie Powell, Charlie Weems, Andy Wright, Clarence Norris, and Haywood Patterson. These forms, dated 1938 Nov. 1, provide information on the dates of prison terms and remarks on the individuals' behavior in prison.
