Biographical History
The commission is to supervise railroads and rail carriers and to enforce laws regulating to railroad companies within the Commonwealth. Also, the commission monitors and regulates rate schedules and operating practices, hears complaints, conducts safety inspections, and authorizes the discontinuation of service. The duties of the commission are assigned by KRS Chapter 276. Membership of the commission is composed of three members. The members are elected from separate districts and serve four-year terms. The commission may also enter into agreements with the Federal Railroad Administration to administer the provisions of the Federal Railroad Safety Act.
The Commission was established by Article 209 of the 1891 Constitution to supervise railroads and to enforce laws regulating railroad companies.
The Commission's membership consisted of three members who were appointed by the Governor and approved by the Senate, and one elected member from each of the state's superior court districts.
In 1976 the General Assembly attached the Commission to the office of Secretary of the Department of Transportation.
