Determination of Need Program (Massachusetts)

Pursuant to MGLA c 111, ss 25B-G and 105 CMR 100, the Determination of Need Program in the Dept. of Public Health reviews applications from health care facilities for capital expenditures in excess of statutory threshold or for substantial changes in services regulated by the state. Series is created by the Public Health Council, which approves or rejects such applications.

Information includes conditions or reasons for approval or rejection, and amount of expenditure authorized if any.

Pursuant to MGLA c 111, ss 25B-G (St 1972, s 776 as amended) and 105 CMR 100, health care facilities in Massachusetts wishing to make capital expenditures in excess of statutory threshold to purchase equipment, erect buildings, or add to buildings, or to make substantial changes in services regulated by the state, must obtain a certificate of need from the Public Health Council. The staff of the Determination of Need Program (Bureau of Health Care Systems, Dept. of Public Health) is responsible for analyzing applications for certificate of need and making recommendations thereon to the council.
